That&#8217;s why we take the\nutmost care and use state-of-the-art security standards to ensure maximum\nprotection of your personal information.<\/p>\n\n\n\n<p>As a private company, we are subject to\nthe provisions of the European General Data Protection Regulation (GDPR) and\nthe regulations of the German Federal Data Protection Act (BDSG). We have taken\ntechnical and organizational measures which ensure that data protection\nregulations are observed by us and by our external service providers.<\/p>\n\n\n\n<p><strong>Definitions<\/strong><\/p>\n\n\n\n<p>The law requires that personal data be\nprocessed lawfully, in good faith and in a manner that is transparent to the\ndata subject (&#8220;lawfulness, fairness, transparency&#8221;). To ensure this,\nwe would like to inform you of the legal definitions that are used in this\nPrivacy Statement:<\/p>\n\n\n\n<p><br>\n<strong>1. Personal data<\/strong><\/p>\n\n\n\n<p>&#8220;Personal data&#8221; means any\ninformation relating to an identified or identifiable natural person\n(hereinafter the &#8220;data subject&#8221;). A natural person is considered to\nbe identifiable if he or she can be identified directly or indirectly, in\nparticular by association with an identifier such as a name, an identification\nnumber, location data, an online identifier, or one or more special features\nwhich express the physical, physiological, genetic, mental, economic, cultural\nor social identity of the natural person.<\/p>\n\n\n\n<p><br>\n<strong>2. Processing<\/strong><\/p>\n\n\n\n<p>&#8220;Processing&#8221; means any\noperation or set of operations which is performed on personal data, whether or\nnot by automated means, such as collection, recording, organization,\nstructuring, storage, adaptation or alteration, retrieval, consultation, use,\ndisclosure by transmission, dissemination or otherwise making available,\nalignment or combination, restriction, erasure or destruction.<\/p>\n\n\n\n<p><br>\n<strong>3. Restriction of processing<\/strong><\/p>\n\n\n\n<p>&#8220;Restriction of processing&#8221;\nmeans the marking of stored personal data with the aim of limiting its\nprocessing in the future.<\/p>\n\n\n\n<p><br>\n<strong>4. Profiling<\/strong><\/p>\n\n\n\n<p>\u201dProfiling\u201c means any form of automated\nprocessing of personal data consisting of the use of personal data to evaluate\ncertain personal aspects relating to a natural person, in particular to analyze\nor predict aspects concerning that natural person&#8217;s performance at work,\neconomic situation, health, personal preferences, interests, reliability,\nbehavior, location or movements.<\/p>\n\n\n\n<p><br>\n<strong>5. Pseudonymization<\/strong><\/p>\n\n\n\n<p>\u201cPseudonymization\u201c means the processing\nof personal data in such a manner that the personal data can no longer be\nattributed to a specific data subject without the use of additional\ninformation, provided that such additional information is kept separately and\nis subject to technical and organizational measures to ensure that the personal\ndata is not attributed to an identified or identifiable natural person<\/p>\n\n\n\n<p><br>\n<strong>6. Filing system<\/strong><\/p>\n\n\n\n<p>\u201cFiling system\u201c means any structured\nset of personal data which is accessible according to specific criteria,\nwhether centralized, decentralized or dispersed on a functional or geographical\nbasis.<\/p>\n\n\n\n<p><br>\n<strong>7. Controller<\/strong><\/p>\n\n\n\n<p>\u201cController\u201c means the natural or legal\nperson, public authority, agency or other body which, alone or jointly with\nothers, determines the purposes and means of the processing of personal data.\nWhere the purposes and means of such processing are determined by European\nUnion or Member State law, the controller or the specific criteria for its\nnomination may be provided for by European Union or Member State law.<\/p>\n\n\n\n<p><br>\n<strong>8. Processor<\/strong><\/p>\n\n\n\n<p>\u201cProcessor\u201c means a natural or legal\nperson, public authority, agency or other body which processes personal data on\nbehalf of the controller.<\/p>\n\n\n\n<p><br>\n<strong>9. Recipient<\/strong><\/p>\n\n\n\n<p>\u201cRecipient\u201c means a natural or legal\nperson, public authority, agency or another body, to which the personal data is\ndisclosed, whether a third party or not. However, public authorities which may\nreceive potentially personal data in the framework of a particular inquiry in\naccordance with European Union or Member State law shall not be regarded as\nrecipients. The processing of that data by those public authorities shall be in\ncompliance with the applicable data protection rules according to the purposes\nof the processing.<\/p>\n\n\n\n<p><br>\n<strong>10. Third party<\/strong><\/p>\n\n\n\n<p>A \u201cthird party\u201c means a natural or\nlegal person, public authority, agency or body other than the data subject,\ncontroller, processor and persons who, under the direct authority of the\ncontroller or processor, are authorized to process personal data.<\/p>\n\n\n\n<p><br>\n<strong>11. Consent<\/strong><\/p>\n\n\n\n<p>The \u201cconsent\u201c of the data subject means\nany freely given, specific, informed and unambiguous indication of the data\nsubject&#8217;s wishes by which he or she, by a statement or by a clear affirmative\naction, signifies agreement to the processing of personal data relating to him\nor her.<\/p>\n\n\n\n<p><strong>Lawfulness of processing<\/strong><\/p>\n\n\n\n<p>The processing of personal data is only\nlawful if there is a legal basis for such processing. Pursuant to Article 6 (1)\n(a) &#8211; (f) of the GDPR, the legal basis for the processing may be in particular:<\/p>\n\n\n\n<p>a. The data subject has given consent\nto the processing of his or her personal data for one or more specific purposes<\/p>\n\n\n\n<p>b. Processing is necessary for the\nperformance of a contract to which the data subject is party or in order to\ntake steps at the request of the data subject prior to entering into a contract<\/p>\n\n\n\n<p>c. Processing is necessary for\ncompliance with a legal obligation to which the controller is subject<\/p>\n\n\n\n<p>d. Processing is necessary in order to\nprotect the vital interests of the data subject or of another natural person<\/p>\n\n\n\n<p>e. Processing is necessary for the\nperformance of a task carried out in the public interest or in the exercise of\nofficial authority vested in the controller<\/p>\n\n\n\n<p>f. Processing is necessary for the\npurposes of the legitimate interests pursued by the controller or by a third\nparty, except where such interests are overridden by the interests or\nfundamental rights and freedoms of the data subject which require protection of\npersonal data, in particular where the data subject is a child.<\/p>\n\n\n\n<p><strong>Information regarding the collection of\npersonal data<\/strong><\/p>\n\n\n\n<p>(1) Below, we inform you of the\ncollection of personal data when using our website. Personal data is e.g. you\nname, address, email addresses, user behavior, etc. <\/p>\n\n\n\n<p>(2) When contacting us by email, the\ninformation you provide (your email address and, if applicable, your name and\nyour telephone number) is stored by us in order to answer your questions. We\ndelete the data collected in this manner once storage is no longer required, if\nprocessing is restricted, or in the event that legal retention obligations\nexist.<\/p>\n\n\n\n<p><strong>Collection of personal data when visiting our website<\/strong><\/p>\n\n\n\n<p>When you merely use the website for\ninformational purposes, i.e. if you do not register or otherwise provide\ninformation to us, we only collect the personal data that your browser\ntransmits to our server. If you wish to view our website, we collect the\nfollowing data which is technically necessary for us to display our website to\nyou and to ensure its stability and security (here, the legal basis is Article\n6 (1) (f) GDPR):<\/p>\n\n\n\n<p>\u2013 IP address<br>\n\u2013 date and time of the request<br>\n\u2013 time zone difference to Greenwich Mean Time (GMT)<br>\n\u2013 content of the request (specific page)<br>\n\u2013 access status\/HTTP status code<br>\n\u2013 each transmitted volume of data <br>\n\u2013 website from which the request originates<br>\n\u2013 browser<br>\n\u2013 operating system and its user interface<br>\n\u2013 language and version of the browser software<br>\n<br>\n<strong>Use of Cookies<\/strong><\/p>\n\n\n\n<p>(1) In addition to the aforementioned\ndata, cookies are stored on your computer when you use our website. Cookies are\nsmall text files that are stored on your hard drive and that are assigned to\nthe browser you are using and that provide certain information to the entity\nthat sets the cookie. Cookies cannot execute programs or transmit viruses to\nyour computer. The advertised goods and services are\ndesignated in the declaration of consent.<\/p>\n\n\n\n<p>(2)\nTo register for our newsletter, we use what is called the double opt-in\nprocess. This means that after you have registered, we will send you an email\nto the email address specified and in which we ask you to confirm that you wish\nto receive the newsletter. If you do not confirm your registration within 24\nhours, your information will be blocked and automatically deleted after one\nmonth. The legal basis is\nArticle 6 (1) (a) GDPR.<\/p>\n\n\n\n<p>(4)\nYou can revoke your consent to have the newsletter sent at any time and\nunsubscribe from the newsletter. You can declare your revocation of consent by\nclicking on the link provided in each newsletter email, via this form on the\nwebsite, by email to info@company.de or\nby sending a message to the contact point listed in the site legal notice.<\/p>\n\n\n\n<p>(5)\nPlease note that we analyze your user behavior when sending the newsletter. To perform\nthis analysis, the emails sent include what are known as web beacons or\ntracking pixels, which are one-pixel image files stored on our website. For our\nanalysis, we link the data mentioned above and the web beacons with your email\naddress and an individual ID. The data is collected exclusively in\npseudonymized manner, which means that the IDs are not linked to your other\npersonal data and a direct personal reference to you is excluded. You can\nobject to this tracking at any time by clicking on the separate link provided\nin each email or by informing us via another contact method. The information\nwill be stored for as long as you have subscribed to the newsletter. Once you\nunsubscribe, we store the data purely for statistical purposes and in anonymized\nform.<\/p>\n\n\n\n<p><strong>Minors<\/strong><\/p>\n\n\n\n<p>Our offer is basically aimed at people\nwho have reached the age of 16. Persons under the age of 16 should not submit\nany personal information to us without the consent of their parent or legal\nguardian.<\/p>\n\n\n\n<p><strong>Rights of data subjects<\/strong><br>\n<strong>(1) Revocation of consent<\/strong><\/p>\n\n\n\n<p>If your personal data is processed on\nthe basis of consent which you have given us, you have the right to revoke your\nconsent at any time. The revocation of consent does not affect the legality of\nthe processing performed on the basis of the consent until the time of\nrevocation.<\/p>\n\n\n\n<p>You can contact us at any time to\nexercise your right to revoke consent.<\/p>\n\n\n\n<p><strong>(2) Right to confirmation<\/strong><\/p>\n\n\n\n<p>You have the right to request\nconfirmation from the controller that we are processing personal data\nconcerning you. You can request this confirmation at any time using the contact\ndetails above.<\/p>\n\n\n\n<p><strong>(3) Right to information<\/strong><\/p>\n\n\n\n<p>In the event that personal data is\nprocessed, you can request information about this personal data and the\nfollowing information at any time: <\/p>\n\n\n\n<p>a. the purposes\nof the processing<br>\nb. the categories of personal data being processed<br>\nc. the recipients or categories of recipients to whom the personal data has\nbeen or is being disclosed, in particular in the case of recipients in third\ncountries or international organizations<br>\nd. if possible, the planned duration for which the personal data is stored or,\nif this is not possible, the criteria for determining this duration<br>\ne. the existence of a right to rectification or erasure of the personal data\nconcerning you, or to a restriction of processing by the controller or a right\nto object to such processing<br>\nf. the existence of a right to lodge a complaint with a supervisory authority<br>\ng. if the personal data is not collected from the data subject, all available\ninformation on the source of the data<br>\nh. the existence of automated decision-making, including profiling, in\naccordance with Article 22 (1) and (4) GDPR and, at least in these cases,\nmeaningful information about the logic involved and the scope and intended\nimpact of such processing on the data subject<\/p>\n\n\n\n<p>If personal data is transferred to a\nthird country or to an international organization, you have the right to be\ninformed of the appropriate safeguards under Article 46 of the GDPR in\nconnection with the transfer. We provide a copy of the personal data that is\nthe subject of the processing. For any additional copies you request of a\nperson, we may charge a reasonable fee based on our administrative costs. If\nyour request is submitted electronically, the information must be provided in a\nstandard electronic format, unless otherwise stated. The right to receive a\ncopy under paragraph 3 shall not affect the rights and freedoms of others.<\/p>\n\n\n\n<p><strong>(4) Right to rectification<\/strong><\/p>\n\n\n\n<p>You have the right to demand the\nimmediate correction of incorrect personal data concerning you. Taking into\naccount the purposes of processing, you have the right to request the\ncompletion of incomplete personal data, including by means of a supplementary\nstatement.<\/p>\n\n\n\n<p><strong>(5) Right to erasure (\u201cright to be forgotten\u201c)<\/strong><\/p>\n\n\n\n<p>You have the right to demand that the\ncontroller erase personal data concerning you without undue delay, and we are\nobligated to erase personal data without undue delay where one of the following\ngrounds applies:<\/p>\n\n\n\n<p>a. the personal\ndata are no longer necessary in relation to the purposes for which they were\ncollected or otherwise processed<br>\nb. the data subject withdraws the consent on which the processing is based\naccording to point (a) of Article 6(1), or point (a) of Article 9(2), and there\nis no other legal ground for the processing<br>\nc. the data subject objects to the processing pursuant to Article 21(1) GDPR\nand there are no overriding legitimate grounds for the processing, or the data\nsubject objects to the processing pursuant to Article 21(2) GDPR;<br>\nd. the personal data have been unlawfully processed<br>\ne. personal data must be erased for compliance with a legal obligation in Union\nor Member State law to which the controller is subject<br>\nf. the personal data was collected in relation to the offer of information\nsociety services referred to in Article 8(1) GDPR<\/p>\n\n\n\n<p>If the controller has made the personal\ndata public and is obliged pursuant to paragraph 1 to erase the personal data,\nthe controller, taking account of available technology and the cost of\nimplementation, shall take reasonable steps, including technical measures, to\ninform controllers which are processing the personal data that the data subject\nhas requested the erasure by such controllers of any links to, or copy or\nreplication of, that personal data. The right to erasure (\u201cright to be\nforgotten\u201c) does not apply to the extent that the processing is necessary: <\/p>\n\n\n\n<p>\u2013 to exercise\nthe right of freedom of expression and information<br>\n\u2013 for compliance with a legal obligation which requires processing by Union or\nMember State law to which the controller is subject or for the performance of a\ntask carried out in the public interest or in the exercise of official\nauthority vested in the controller<br>\n\u2013 for reasons of public interest in the area of public health in accordance\nwith points (h) and (i) of Article 9(2) as well as Article 9(3) GDPR<br>\n\u2013 for archiving purposes in the public interest, scientific or historical\nresearch purposes or statistical purposes in accordance with Article 89(1) GDPR\nin so far as the right referred to in paragraph 1 is likely to render\nimpossible or seriously impair the achievement of the objectives of that\nprocessing; or<br>\n\u2013 for the establishment, exercise or defense of legal claims<\/p>\n\n\n\n<p><br>\n<strong>(6) Right to restriction of processing<\/strong><\/p>\n\n\n\n<p>You have the right to request that we\nrestrict the processing of your personal data if any of the following\nconditions apply:<\/p>\n\n\n\n<p>a. the accuracy\nof the personal data is contested by the data subject, for a period enabling\nthe controller to verify the accuracy of the personal data<br>\nb. the processing is unlawful and the data subject opposes the erasure of the\npersonal data and requests the restriction of their use instead<br>\nc. the controller no longer needs the personal data for the purposes of the\nprocessing, but the data is required by the data subject for the establishment,\nexercise or defense of legal claims, or<br>\nd. the data subject has objected to processing pursuant to Article 21(1) GDPR\npending the verification whether the legitimate grounds of the controller\noverride those of the data subject<\/p>\n\n\n\n<p>In the event that processing has been\nrestricted under the aforementioned conditions, this personal data shall \u2013 with\nthe exception of storage \u2013 only be processed with the data subject\u2019s consent or\nfor the establishment, exercise or defense of legal claims or for the\nprotection of the rights of another natural or legal person or for reasons of\nimportant public interest of the Union or of a Member State.<\/p>\n\n\n\n<p>In order to exercise the right to\nrestrict processing, the data subject may contact us at any time using the\ncontact details provided above.<\/p>\n\n\n\n<p><strong>(7) Right to data portability<\/strong><\/p>\n\n\n\n<p>You have the right to receive the\npersonal data concerning you which you have provided to us in a structured,\ncommonly used and machine-readable format and have the right to transmit that\ndata to another controller without hindrance from the controller to which the\npersonal data have been provided, to the extent that:<\/p>\n\n\n\n<p>a. the\nprocessing is based on consent pursuant to point (a) of Article 6 (1) or point\n(a) of Article 9 (2) or on a contract pursuant to point (b) of Article 6 (1)\nGDPR and<br>\nb. the processing is carried out by automated means<\/p>\n\n\n\n<p>In exercising your right to data\nportability pursuant to paragraph 1, you have the right to have the personal\ndata transmitted directly from one controller to another, to the extent that\nthis is technically feasible. The exercise of the right to data portability\ndoes not affect your right to erasure (\u201cright to be forgotten\u201d). That right\nshall not apply to processing necessary for the performance of a task carried\nout in the public interest or in the exercise of official authority vested in\nthe controller.<\/p>\n\n\n\n<p><strong>(8) Right to object<\/strong><\/p>\n\n\n\n<p>You have the right to object, on\ngrounds relating to your particular situation, at any time to processing of\npersonal data which concerns you which is based on point (e) or (f) of Article\n6 (1) GDPR, including profiling based on those provisions. If objection is\nmade, the controller will no longer process the personal data unless the\ncontroller demonstrates compelling legitimate grounds for the processing which\noverride the interests, rights and freedoms of the data subject or for the\nestablishment, exercise or defense of legal claims.<\/p>\n\n\n\n<p>In the event that personal data is\nprocessed for direct marketing purposes, you have the right to object at any\ntime to processing of personal data concerning you for such marketing. This\nalso applies to profiling to the extent that it is related to such direct\nmarketing. If you object to processing for direct marketing purposes, your\npersonal data shall no longer be processed for such purposes.<\/p>\n\n\n\n<p>Regarding the use of information\nsociety services, and notwithstanding Directive 2002\/58\/EC, you can exercise\nyour right to object by automated means using technical specifications.<\/p>\n\n\n\n<p>Where personal data are processed for\nscientific or historical research purposes or statistical purposes pursuant to\nArticle 89 (1), you, on grounds relating to your particular situation, have the\nright to object to processing of personal data concerning you, unless the\nprocessing is necessary for the performance of a task carried out for reasons\nof public interest.<\/p>\n\n\n\n<p>The right of objection can be exercised\nat any time by contacting the respective controller.<\/p>\n\n\n\n<p><strong>(9) Automated individual decision-making, including\nprofiling<\/strong><\/p>\n\n\n\n<p>You have the right not to be subject to\na decision based solely on automated processing, including profiling, which\nproduces legal effects for you or similarly significantly affects you. This\ndoes not apply if the decision:<\/p>\n\n\n\n<p>a. is necessary\nfor entering into, or performance of, a contract between the data subject and a\ndata controller<br>\nb. is authorized by Union or Member State law to which the controller is\nsubject and which also lays down suitable measures to safeguard the data\nsubject\u2019s rights and freedoms and legitimate interests, or<br>\nc. is based on the data subject\u2019s explicit consent<\/p>\n\n\n\n<p>The controller shall implement suitable\nmeasures to safeguard the data subject\u2019s rights and freedoms and legitimate\ninterests, at least the right to obtain human intervention on the part of the\ncontroller, to express his or her point of view and to contest the decision.<\/p>\n\n\n\n<p>This right can be exercised by the data\nsubject at any time by contacting the respective controller.<\/p>\n\n\n\n<p><strong>(10) Right to lodge a complaint with a supervisory\nauthority<\/strong><\/p>\n\n\n\n<p>You also have\nthe right, without prejudice to any other administrative or judicial remedy, to\nlodge a complaint with a supervisory authority, in particular in the Member\nState of your habitual residence, place of work or place of the alleged\ninfringement if you as data subject consider that the processing of personal\ndata relating to you infringes this Regulation.<\/p>\n\n\n\n<p><strong>(11) Right to effective judicial remedy<\/strong><\/p>\n\n\n\n<p>Without\nprejudice to any other available administrative or judicial remedy, including\nthe right to lodge a complaint with a supervisory authority pursuant to Article\n77 GDPR, you have the right to an effective judicial remedy if you consider\nthat your rights under this Regulation have been infringed as a result of the\nprocessing of your personal data in breach of this Regulation.<\/p>\n\n\n\n<p><strong>Use of Google\nAnalytics<\/strong><\/p>\n\n\n\n<p>(1)\nThis website uses Google Analytics, a web analytics service provided by Google\nInc.
